The Keap application Customer Relationship Management (CRM) tool is designed to support your efforts to meet obligations under the Health Insurance Portability and Accountability Act of 1996 and its implementing regulations (collectively, HIPAA). However, the email and short message service (SMS) functionalities accessible from or through the CRM (collectively, the Messaging Services) are not HIPAA-compliant and are not intended for the transmission, storage, or processing of protected health information (PHI) or any other data requiring HIPAA-level safeguards.
By accessing or using the Messaging Services, you acknowledge and agree that: (a) the Messaging Services are not subject to HIPAA compliance; (b) you will not transmit, store, or process PHI or other regulated data through the Messaging Services; and (c) you are solely responsible for implementing policies, procedures, and technical measures to ensure that no PHI or other regulated data is sent via the Messaging Services.
To the maximum extent permitted by applicable law, Thryv, Inc. and its providers disclaims all responsibility and liability arising from or related to any transmission, storage, or processing of PHI or other regulated data through the Messaging Services, including without limitation any resulting disclosures, breaches, penalties, losses, or damages.
